"Is Bankruptcy the Right Choice?"

Dear Gerry,

Articles such as "Is Bankruptcy the Right Choice" (7/8/09) are of course by their nature superficial and abbreviated, but as an attorney and C.P.A. who has specialized in the practice of bankruptcy law for almost 30 years, I would like to correct the most glaring misstatement. It was state that "In Chapter 7 bankruptcy, your assets are sold and the proceeds are used to pay your creditors." In fact it is a rare event if an individual chapter 7 debtor loses any of his assets. In over 95% of such cases that I handle, all assets are claimed "exempt" and retained by the debtors.
